These Terms and Conditions of Sale, hereinafter referred to as the “Terms and Conditions”, govern bookings and purchases of services offered by La Ferme de l’Oudon & Spa.

ARTICLE 1 — PURPOSE AND SCOPE

These Terms and Conditions define the rights and obligations of La Ferme de l’Oudon & Spa and its guests in connection with the booking and sale of accommodation, wellness services, Table d’Hôtes meals, additional services and gift vouchers.

Any booking implies that the guest has read and unreservedly accepted these Terms and Conditions.

The guest acknowledges having received, prior to booking, the necessary information concerning the essential characteristics of the services, their prices and these Terms and Conditions.

The Terms and Conditions applicable are those in force on the date the booking is made.

ARTICLE 2 — GOVERNING LAW AND REFERENCE LANGUAGE

These Terms and Conditions are governed by French law.

The reference language of these Terms and Conditions is French. In the event of a translation into another language and any discrepancy in interpretation, the French version shall prevail.

ARTICLE 3 — BOOKINGS

Bookings may be made through the La Ferme de l’Oudon & Spa website, by telephone or through any other booking channel offered by the establishment.

A booking becomes confirmed once the required information has been validated, these Terms and Conditions have been accepted and, where required, the amount due at the time of booking has been paid.

A booking confirmation is sent to the guest by email.

The guest is responsible for the accuracy of the information provided when making the booking, including contact and payment details.

La Ferme de l’Oudon & Spa reserves the right to cancel a booking if the bank card details provided are invalid or if the required payment cannot be processed.

All services are subject to availability.

La Ferme de l’Oudon & Spa may impose a minimum number of nights and/or specific rate conditions or associated services during periods of high demand, particularly weekends, public holidays, long weekends and school holidays.

ARTICLE 4 — PRICES

Prices are stated in euros and include all applicable taxes unless otherwise indicated.

Any applicable taxes, including tourist tax, are specified at the time of booking or on the invoice in accordance with current regulations.

Rates may be changed at any time. However, a confirmed booking will be charged at the rate accepted by the guest at the time of booking.

The services included in each rate are those expressly stated at the time of booking.

ARTICLE 5 — ACCOMMODATION BOOKING CONDITIONS

5.1 — Guest Rooms

For Guest Rooms, 50% of the total cost of the stay is paid by bank card at the time of booking.

The remaining balance is payable upon arrival.

Accepted payment methods are:

• bank card;
• cash.

Cancellation

For cancellations made 5 days or more before the scheduled arrival date, the amount already charged will be refunded.

For cancellations made 4 days or less before the scheduled arrival date, the 50% already paid will be retained by La Ferme de l’Oudon & Spa and the remaining balance of the stay will become payable. It may be charged to the bank card provided at the time of booking.

In the event of a no-show or if the guest chooses to shorten their stay, the full amount of the originally booked stay remains payable.

Breakfast

For Guest Rooms, breakfast is included in the rate and is served directly in the accommodation.

5.2 — Suites

For Suites, 50% of the total cost of the stay is paid by bank card at the time of booking.

The remaining balance is payable upon arrival.

Accepted payment methods are:

• bank card;
• cash.

Cancellation

For cancellations made 7 days or more before the scheduled arrival date, the amount already charged will be refunded.

For cancellations made 6 days or less before the scheduled arrival date, the 50% already paid will be retained by La Ferme de l’Oudon & Spa and the remaining balance of the stay will become payable. It may be charged to the bank card provided at the time of booking.

In the event of a no-show or if the guest chooses to shorten their stay, the full amount of the originally booked stay remains payable.

Breakfast

Breakfast is not included in the Suite rate unless otherwise stated in the offer booked.

It may be added to the stay at the applicable rate.

As of the date these Terms and Conditions were drafted:

€20 per adult and €15 per child under 12.

5.3 — Guesthouses

For Guesthouses, 50% of the total cost of the stay is paid by bank card at the time of booking.

The remaining balance is payable upon arrival.

Accepted payment methods are:

• bank card;
• cash.

Cancellation

For cancellations made 7 days or more before the scheduled arrival date, the amount already charged will be refunded.

For cancellations made 6 days or less before the scheduled arrival date, the 50% already paid will be retained by La Ferme de l’Oudon & Spa and the remaining balance of the stay will become payable. It may be charged to the bank card provided at the time of booking.

€20 per adult and €15 per child under 12.

ARTICLE 6 — OFFERS AND PACKAGES

La Ferme de l’Oudon & Spa offers various packages combining several services.

The services actually included in each offer are those stated to the guest at the time of booking.

“Séjour Découverte” — Discovery Stay

The Discovery Stay includes:

• accommodation;
• access to the Spa at La Ferme de l’Oudon & Spa, subject to the conditions and opening hours set by the establishment.

“Escapade Gourmande” — Gourmet Getaway

The Gourmet Getaway includes:

• accommodation;
• breakfast;
• one Table d’Hôtes dinner per person;
• access to the Spa at La Ferme de l’Oudon & Spa, subject to the conditions and opening hours set by the establishment.

“Parenthèse Détente” — Wellness Getaway

The Wellness Getaway includes:

• accommodation;
• breakfast;
• one Table d’Hôtes dinner per person;
• one 30-minute relaxing massage per person;
• access to the Spa subject to the conditions and opening hours set by the establishment.

Payment Terms for Treatments and Massages

When an offer or package includes a treatment or massage, this service forms an integral part of the offer but is subject to separate payment.

The guest must therefore make two separate payments:

• one payment covering the accommodation and, depending on the offer booked, breakfast, dinners and any other services or extras;
• a separate payment covering the treatment or massage included in the offer.

Treatments and massages are paid for by bank card or cash.

For all offers and packages, the description, price and services stated at the time of booking shall prevail.

ARTICLE 7 — EXTRAS AND ADDITIONAL SERVICES

Available extras may include:

• breakfast;
• Table d’Hôtes dinners;
• treatments and massages;
• aperitif platters;
• bouquets of flowers;
• Champagne;
• chocolates;
• romantic touches;
• and any other service offered at the time of booking.

Unless specific conditions are stated at the time of purchase, extras may be cancelled free of charge up to 24 hours before the scheduled date or time of the service.

Treatments and massages remain subject to the specific conditions set out in Article 9.

For breakfasts ordered during the stay, cancellation is possible until 3:00 pm on the day before service.

After these deadlines, the booked service will be charged in full.

ARTICLE 8 — TABLE D’HÔTES

La Ferme de l’Oudon & Spa does not operate a traditional restaurant but offers a Table d’Hôtes service exclusively for guests staying at the property.

Table d’Hôtes dinners are available by reservation and subject to availability.

Reservations must be made at least 24 hours in advance.

Dinners are served directly in the accommodation between 7:00 pm and 7:30 pm.

When dinner is booked for the day of arrival, it is the guest’s responsibility to plan their arrival time accordingly and to be present in their accommodation between 7:00 pm and 7:30 pm for dinner service.

The Table d’Hôtes offers a set menu based on the seasons, available produce and the inspiration of the kitchen.

This is not an à la carte restaurant. The menu therefore cannot be altered according to each guest’s individual preferences or tastes.

Any allergies, intolerances or dietary requirements must be reported before booking the meal. La Ferme de l’Oudon & Spa will inform the guest whether or not these requirements can be accommodated.

La Ferme de l’Oudon holds the appropriate licence allowing alcoholic beverages to be served to guests as part of the services permitted under that licence.

ARTICLE 9 — TREATMENTS, MASSAGES AND WELLNESS SERVICES

Treatments and massages are available exclusively by reservation and are subject to practitioner availability.

They are paid for separately from accommodation and other services included in the stay, including when a treatment or massage forms part of an offer or package.

Payment is made on site by bank card or cash.

No payment is taken when booking a treatment, except where payment becomes due under the late cancellation conditions below.

Cancellation Conditions

Cancellation is free of charge up to 24 hours before the scheduled appointment time.

For cancellations made less than 24 hours before the appointment or in the event of a no-show, the full cost of the service is payable.

ARTICLE 10 — SPA AND WELLNESS AREAS

Access to the Spa is exclusively reserved for guests staying at La Ferme de l’Oudon & Spa.

Unless specific conditions apply to certain accommodation, the Spa is open from 9:30 am to 8:00 pm.

Facilities include a heated indoor swimming pool, infrared sauna and relaxation area.

Spa access is included with all accommodation bookings.

Certain facilities may be reserved for the private use of guests staying in specific accommodation during designated periods.

The exact conditions and times applicable are those stated in the accommodation description at the time of booking.

The swimming pool is unsupervised.

Children must remain under the supervision and responsibility of their parents or accompanying adults at all times.

Running and diving in the pool area are prohibited.

Guests are required to respect the peaceful atmosphere of the premises and the comfort of other guests.

For safety, servicing or maintenance reasons, or in exceptional circumstances, all or part of the Spa may be temporarily unavailable.

ARTICLE 11 — BANK CARD PRE-AUTHORISATION AND GUARANTEE

A €150 bank card pre-authorisation is required as a guarantee:

• for guests staying in accommodation with a private hot tub;
• for any guest staying with a pet.

This pre-authorisation serves as a guarantee and does not normally result in an immediate charge.

The guarantee may be used, in whole or in part, in particular in the following circumstances:

• damage to the accommodation or its equipment;
• damage to the hot tub;
• accommodation left in an abnormally dirty condition requiring exceptional cleaning or a specific intervention;
• exceptional cleaning required as a result of the behaviour of the guest or their pet;
• missing equipment or items.

If no issue is identified, the pre-authorisation is released in accordance with the processing times of the guest’s bank.

If the cost of the damage or expenses incurred exceeds €150, La Ferme de l’Oudon & Spa reserves the right to request payment of the additional amount corresponding to the loss or damage incurred.

In the event of significant damage, the guest may also be required to make a claim under their personal liability insurance.

ARTICLE 12 — CLEANLINESS AND HOUSEKEEPING

Normal end-of-stay cleaning is provided by La Ferme de l’Oudon & Spa.

Before departure, guests are nevertheless asked to leave their accommodation in a generally clean and tidy condition, out of respect for our housekeeping team.

For Suites and Guesthouses, guests are specifically asked to:

• clean and tidy any kitchen or kitchenette used;
• wash and put away any dishes used;
• dispose of rubbish in the designated areas;
• leave the accommodation in a generally clean and tidy condition.

La Ferme de l’Oudon & Spa takes care of the remainder of the end-of-stay cleaning, including floors, toilets, bathrooms, linen and general cleaning of the accommodation.

If accommodation is left in an abnormally dirty condition requiring a particularly significant amount of additional cleaning or a specific intervention, additional charges corresponding to the exceptional cleaning required may be invoiced, up to a maximum of €150, or charged against the guarantee referred to in Article 11 where applicable.

ARTICLE 13 — MINIBAR AND DRINKS

La Ferme de l’Oudon & Spa provides guests with a selection of chargeable drinks in the refrigerators or minibars of the relevant accommodation.

Drink prices are displayed directly in each accommodation.

Guests agree to report any drinks consumed during their stay at the time of departure.

Any drinks consumed will be added to the bill and paid for upon departure.

ARTICLE 14 — ARRIVAL AND DEPARTURE

Guest Rooms and Suites are available from 3:00 pm.

Guesthouses are available from 4:00 pm.

All accommodation must be vacated by 11:00 am at the latest on the day of departure.

For arrivals after 7:00 pm, self-check-in applies in accordance with the access instructions provided to the guest before their stay.

On Sundays, all arrivals are by self-check-in, regardless of arrival time, in accordance with the instructions provided to the guest in advance.

It is the guest’s responsibility to read this information before arrival and to ensure that they have the necessary instructions to access their accommodation.

Arrival with a Dinner Reservation

Table d’Hôtes dinners are served directly in the accommodation between 7:00 pm and 7:30 pm.

When dinner is booked for the day of arrival, the guest must plan their arrival time to ensure that they are present in their accommodation between 7:00 pm and 7:30 pm for dinner service.

It is therefore the guest’s responsibility to take this schedule into account when planning their journey and arrival at La Ferme de l’Oudon & Spa.

Any request for early arrival or late departure is subject to availability and prior approval by La Ferme de l’Oudon & Spa.

An additional charge may apply where this has been communicated to and accepted by the guest.

ARTICLE 15 — USE OF THE ACCOMMODATION AND PREMISES

The stay may not exceed the duration specified in the booking.

Guests have no right to remain on the premises after the end of the booked stay.

Accommodation must not be occupied beyond its stated maximum capacity.

No additional undeclared person may stay in the accommodation without the prior approval of La Ferme de l’Oudon & Spa.

If the maximum occupancy is exceeded without authorisation, the establishment may terminate the stay where permitted by applicable law.

All indoor areas of the establishment are non-smoking.

Guests must use the premises and equipment reasonably, respectfully and for their intended purpose.

Guests must preserve the peaceful atmosphere of the property and respect other guests, staff, animals and the environment.

Any dangerous, violent or abusive behaviour, or behaviour causing significant disturbance, may result in La Ferme de l’Oudon & Spa taking the necessary measures to protect the safety and peaceful enjoyment of those present.

ARTICLE 16 — GROUPS, PARTIES AND EVENTS

La Ferme de l’Oudon & Spa is a property dedicated to rest, wellness and relaxation.

Unless expressly agreed in advance by the establishment, group bookings for more than 8 people are not accepted.

Private hire of the entire property for parties or private events is not permitted.

Parties, noisy gatherings, sound systems and music likely to disturb other guests are prohibited.

ARTICLE 17 — PETS

Dogs and cats may be accepted in certain accommodation only with the prior approval of La Ferme de l’Oudon & Spa.

A supplement of €10 per night, per pet applies.

Pets must be kept under control and on a lead in areas where this is required.

They must not cause any disturbance to other guests or to animals living on the property.

Pets must not be left alone in the accommodation.

Owners must pick up after their pets and keep outdoor areas clean.

Any guest staying with a pet is subject to the €150 bank card pre-authorisation referred to in Article 11.

ARTICLE 18 — CHILDREN, FARM ANIMALS AND BODIES OF WATER

Children remain under the full responsibility and supervision of their parents or accompanying adults throughout their stay.

Entering animal enclosures without permission is prohibited.

Children must also be supervised around ponds, bodies of water, the swimming pool, Spa and any other areas that may present a risk.

La Ferme de l’Oudon & Spa cannot be held liable for consequences resulting from failure to comply with these safety instructions, subject to applicable legal provisions.

ARTICLE 19 — PERSONAL BELONGINGS

Guests remain responsible for their personal belongings, luggage, valuables and vehicles.

La Ferme de l’Oudon & Spa cannot be held liable for loss, theft or damage except to the extent provided for under applicable law.

Guests are responsible for taking any precautions and obtaining any insurance they consider necessary.

ARTICLE 20 — GIFT VOUCHERS

La Ferme de l’Oudon & Spa offers monetary-value gift vouchers that may be used towards services offered by the establishment, subject to the conditions stated at the time of purchase and any specific payment arrangements applicable to certain services.

Where a booking includes a treatment or massage that is subject to separate payment, the value of the gift voucher will be applied to the services invoiced by La Ferme de l’Oudon & Spa, excluding the portion corresponding to the treatment or massage paid for separately, unless expressly stated otherwise at the time the gift voucher is purchased.

Unless specific conditions are stated on the gift voucher:

• the gift voucher is valid for 6 months from the date of purchase;
• it must be used in a single transaction;
• it cannot be refunded, either in full or in part;
• it cannot be exchanged for cash;
• it remains the responsibility of the beneficiary, particularly in the event of loss or theft.

If the value of the booking exceeds the value of the gift voucher, the beneficiary must pay the difference.

Bookings are subject to availability.

Stays paid for using a gift voucher may be changed or cancelled without loss of the voucher up to 7 days before the scheduled arrival date.

For cancellations made less than 7 days before arrival or in the event of a no-show, the gift voucher will be considered used and cannot be postponed, reissued or refunded.

ARTICLE 21 — UNAVAILABILITY AND CHANGES TO SERVICES

All services are subject to availability.

If, in exceptional circumstances, a service becomes unavailable after booking, La Ferme de l’Oudon & Spa will inform the guest as soon as possible and, where possible, seek an appropriate alternative solution.

La Ferme de l’Oudon & Spa may change the services offered for future bookings.

Such changes will not affect services that have already been contractually confirmed, except in exceptional circumstances beyond the establishment’s control or with the guest’s agreement.

ARTICLE 22 — FORCE MAJEURE

La Ferme de l’Oudon & Spa shall not be held liable for any failure or delay in performance resulting from an event constituting force majeure under French law.

Such events may include, where they meet the legal requirements for force majeure, natural disasters, fires, flooding, exceptional weather events, administrative decisions or significant interruptions to networks or services essential to the operation of the establishment.

ARTICLE 23 — PERSONAL DATA

Personal data provided by guests is used for the management of bookings, payments and customer relations and, where the guest has given consent, for marketing communications.

Guests have the rights provided for under applicable personal data protection regulations, including rights of access and rectification and, where provided for by applicable regulations, rights to erasure or objection.

ARTICLE 24 — INTELLECTUAL PROPERTY

The texts, photographs, illustrations, logos, graphic elements and other content appearing on the La Ferme de l’Oudon & Spa website are protected by applicable intellectual property laws.

Any unauthorised reproduction or use, in whole or in part, is prohibited without prior written permission.

ARTICLE 25 — COMPLAINTS

Any issue identified concerning the accommodation or its facilities must be reported to La Ferme de l’Oudon & Spa as soon as possible so that the establishment has an opportunity to resolve it during the stay.

The parties will endeavour to reach an amicable resolution.

ARTICLE 26 — DISPUTES, MEDIATION AND GOVERNING LAW

These Terms and Conditions are governed by French law.

In the event of a dispute, the guest is invited to contact La Ferme de l’Oudon & Spa in the first instance in order to seek an amicable resolution.

In accordance with the applicable provisions of the French Consumer Code, a consumer guest may, after first submitting a written complaint to La Ferme de l’Oudon & Spa and where no amicable solution has been reached, refer the matter free of charge to the consumer mediator responsible for the establishment.

If the dispute cannot be resolved amicably or through mediation, it may be brought before the competent court in accordance with the applicable rules of French law.

ARTICLE 27 — CHANGES TO THESE TERMS AND CONDITIONS

La Ferme de l’Oudon & Spa reserves the right to amend these Terms and Conditions at any time.

New Terms and Conditions apply to bookings made after they have been published online.

Bookings already confirmed remain subject to the Terms and Conditions applicable at the time they were entered into.
