Article 1: object
The sale of services on the Internet is concluded between La Ferme de l’Oudon and a final buyer as part of a distance selling system. The resale of products purchased on the website is strictly prohibited.

Article 2: Applicable law
This contract refers to French law and, more particularly, to the regulations on distance selling.

Article 3: Offer
Acceptance and confirmation of the order are carried out by entering data on successive screen pages. This data appears on a summary screen which includes an explicit mention of the buyer’s firm commitment. Orders are confirmed by email with indication of the identity and references of LA FERME DE l’OUDON with its address and email. The confirmation email includes the essential characteristic of the purchase, the price including tax.

The customer declares to have read and accepted all of these general conditions of sale before placing their order by checking the box provided for this purpose. Validation of the order therefore constitutes acceptance of these general conditions of sale.

Article 4: Sales:
Our products are offered within the limits of our availability and while the establishment is open. Certain products and/or services may be temporarily or permanently unavailable. The unavailability of one or more products and/or services cannot engage the responsibility of LA FERME DE l’OUDON. If one or more products and/or services become unavailable after the order, LA FERME DE l’OUDON will personally notify the customer as soon as possible by email or telephone. The documents published by our services are intended for individual use and may not be reproduced or distributed. The customer may only make one copy of the content from this service and undertakes not to produce or distribute, whether in paper or electronic format, any other copy without the written approval of LA FERME DE OUDON. In the absence of prior authorization communicated in writing by the holder of the protected right, any other use constitutes an infringement and is punishable by the commercial property code. The information contained in the invitations remains the property of LA FERME DE l’OUDON which cannot be held responsible for errors or exceptional modifications beyond its control. LA FERME DE l’OUDON reserves the right to modify the services offered on this site, or to terminate them, without notice while respecting the transactions already concluded.

Article 5: IMPORTANT: opening/closing of the establishment, availability and reservation of services offered at the Oudon farm

All requests for reservations, offers, wellness treatments and table d’hôtes are subject to availability and opening days of the establishment
La Ferme de l’Oudon reserves the right to close the establishment and/or spa without notice for leave or maintenance
Table d’hôte reservation requests must be made at least 48 hours in advance, after this time we will not be able to take any reservations.
The table d’hôtes and access to the SPA are reserved only for customers of the Oudon farm

La Ferme de L’ Oudon does not have a Restaurant but offers a Table d’Hôte service. Unlike traditional catering, we do not offer an à la carte menu but a unique menu, the composition of which depends on the seasons and the inspiration of the Chef. We will not be able to change the menu according to the tastes of our guests.

La Ferme de l’Oudon reserves the right to impose a minimum number of nights and or services imposed for all reservations during the following periods: school holidays in any area, weekends (Friday nights and Saturday evenings), bridges and holidays.
The Oudon farm has a Catering License which authorizes it to serve alcohol to its guests during meals and to offer takeaway sales of alcoholic beverages.

Payment for wellness treatments is made separately from other services in cash or credit card only (ANCVs are not accepted for payment of treatments)

Article 6: Registration of reservations – means of payment

We accept visas, MasterCard, American express, cash and ANCV checks. We do not accept bank checks.

We do not require payment upon reservation. All payment takes place upon arrival of the customer.

When booking we simply pre-authorize the credit card for the reservation. If pre-authorization is refused, the reservation will be immediately canceled without notice.

IMPORTANT: In addition to the price of the stay, we pre-authorize an amount of €150 upon arrival of any guest residing at Ferme de L’Oudon. This amount will be returned on departure except in the event of damage to the equipment (in the accommodation or in the common areas) and/or unacceptable cleanliness of the room.

This amount will also not be returned in the event that the jacuzzi is made dirty or damaged, the amount remaining definitively acquired by the Oudon farm.

We ask all our rental guests to respect the obligation imposed on all tenants to use their accommodation “in good manners”.

In the event of significant damage caused by the tenant, we will ask our guests to take out their civil insurance (this insurance is included with all home insurance).

In the event of minor damage (broken dishes, small material damage) we ask our guests to replace my broken equipment with equivalent equipment.

 

CONDITIONS of reservation and CANCELLATION OF OUR ESTABLISHMENT:

For a reservation with the rates: STANDARD, SEASONAL OFFERS, 3 AND 4 NIGHTS MINIMUM

1. Reservation of rooms or suites:

You will pay 50% of your stay when booking by credit card. The balance will be paid directly upon your arrival. Payment methods accepted: credit card, cash and ANCV. If you wish to pay your entire reservation by cash or ANCV, we can credit the 50% paid for the reservation to your credit card on the day of your arrival. We reserve the right to cancel the reservation in the event of invalid bank details.

For cancellation 5 days or more before your arrival, we will re-credit the amount charged. For a cancellation 4 days or less before your arrival, the 50% paid remains definitive and the rest of the amount of your reservation will be taken from the credit card provided at the time of reservation.

These prices include accommodation and breakfasts served in the accommodation. It also includes free and unlimited access to the SPA (indoor swimming pool and sauna from 9:30 a.m. to 8 p.m.)

As part of the pampering offer, accommodation is included: 2 30-minute massages and breakfasts served in the accommodation. It also includes free and unlimited access to the SPA (indoor swimming pool and sauna from 9:30 a.m. to 8 p.m.) and 1 dinner for 2 people served with a bottle of cider.
Attention ! as part of this offer, payment for wellness treatments is made separately from other services in cash or credit card only (ANCVs are not accepted for payment of treatments)

2. Reservation of houses

You will pay 50% of your stay when booking by credit card. The balance will be paid directly upon your arrival. Payment methods accepted: credit card, cash and ANCV. If you wish to pay your entire reservation by cash or ANCV, we can credit the 50% paid for the reservation to your credit card on the day of your arrival. We reserve the right to cancel the reservation in the event of invalid bank details.

For cancellation 7 days or more before your arrival, we will re-credit the amount charged. For a cancellation 6 days or less before your arrival, the 50% paid remains definitive and the rest of the amount of your reservation will be taken from the credit card provided at the time of reservation.

IMPORTANT: Tenants of Guest Houses (only: Le Lavoir, La Lagune, Le Pressoir and Spa Majorelle) are responsible for returning their accommodation in the clean state in which it was presented to them. In the event that the accommodation is not left in a state of cleanliness deemed satisfactory, a last minute cleaning fee of 150 will apply. Breakfast is not included with the rental of our houses but is offered as accommodation at the rate of €20 per adult and €15 per child under 12 years old.

c) reservation of options (dinners, breakfasts, wellness treatments, bouquet of flowers, Norman aperitif, bottle of champagne, champagne and chocolate tray)

All these options can be canceled free of charge 48 hours before arrival (the day before the service before 3 p.m. for breakfasts). After these deadlines, any option will be charged at 100%.

Article 6: Provision of accommodation and use of premises:

Guest house tenants will be responsible for returning the houses in the same condition as that offered on arrival. In the event that the accommodation is not returned in a state of cleanliness deemed satisfactory, charges will be incurred.

Article 7: Arrival/departure times:
Arrivals can be between 3/4 p.m. and 8 p.m. reception is closed at 8 p.m.
The guest room is available from 3:00 p.m. and must be vacated at 11:00 a.m.
Any room not vacated at this time will be billed as an additional night.
Guest houses are available from 4 p.m. and must be vacated by 11 a.m. on the day of departure.

Article 8: Animals – Environment:
Dogs or cats can be accepted with prior agreement from the owners. A supplement is charged at a flat rate of €20 per night and per animal. Animals must be controlled and kept on a leash and not cause harm to others. They cannot be left alone in rooms or guest houses. Pet owners will be sure to leave the exteriors spotless by putting droppings in the trash.

Tenants must ensure that their children do not enter the enclosures protecting access to animal enclosures, bodies of water and grassland closed by the owners. In the event of non-compliance, tenants assume full responsibility in the event of an accident.

The indoor swimming pool is freely available to all accommodations from 9:30 a.m. to 8 p.m. It is not supervised. Children are the responsibility of their parents. Running and diving are prohibited. It is necessary to respect everyone’s peace and quiet. During maintenance work, the swimming pool may be closed without notice.

Article 9: Price, payment and payment conditions
The prices of our products and/or services are indicated in euros, all taxes included. Applicable current taxes will be indicated on the invoice. All orders whatever their origins are payable exclusively in euros. Prices are set by LA FERME DE l’OUDON, and can therefore be changed at any time. The products and/or services are always invoiced on the basis of the prices in force at the time the order is registered.
Payment is made by credit card, cash or ANCV. The price offered must be paid automatically upon arrival by one of these payment methods. The customer agrees to pay the full price and charges relating to the product purchased, including taxes. Only the user is responsible for payment by credit card for the service and/or the service offered. When making a purchase, the customer may be contacted by the email provided when placing the order. In the event that the contact details transmitted are invalid, LA FERME DE l’OUDON reserves the right to cancel the reservation.

The customer undertakes to personally use the bank card he holds. In the event of fraudulent use, LA FERME DE l’OUDON cannot be held liable. In the absence of bank funds at the time of pre-authorization, the reservation will be automatically canceled. In the event that the pre-authorization proves to be irregular, incomplete or non-existent, for a reason attributable to the customer, the sale of the services will be canceled, the resulting costs being the responsibility of the customer, civil and/or criminal action may be , where applicable, be taken against the customer.

Reservations for any rental on our website are made by credit card payable in euros. The customer must indicate the number, the validity date of their card (CB, Visa, MasterCard) and the visual cryptogram (the last three digits appearing on the signature panel on the back of your bank card). Cards issued by banks domiciled outside France must be international bank cards. Validation of the transaction presupposes that the customer has read and given his agreement to the application of these general conditions of sale.

Article 10: Group reservations

We do not accept reservations for groups of more than 8 people and do not authorize the privatization of our domain for any event. The Farm is indeed a place of relaxation and well-being and we do not accept any noisy parties and/or with music.

Article 11: Personal information
By accepting his reservation, the buyer gives his consent to the use of the personal data collected under the terms of this order, as part of the consumer’s customer file. However, he may object in writing or by e-mail to this use in accordance with Law No. 78-17 of January 6, 1978; The consumer has a right of access and rectification at any time.

Article 12: Limited guarantees and responsibilities
The customer uses the service of the site http://www.fermedeloudon.com at his own risk. FERME DE l’OUDON cannot guarantee under any circumstances that the services offered will not be interrupted. LA FERME DE l’OUDON’s supply obligation is limited to an obligation of means. Likewise, the information that the customer obtains as part of the services offered by LA FERME DE l’OUDON whether on the site http://www.fermedeloudon.com, by email or in the form of a text message does not give right any guarantee from LA FERME DE l’OUDON, to the extent that they are given for information purposes. The language of this contract is French. In the event of a dispute, the Lisieux commercial court will have sole jurisdiction. If the parties fail to resolve disputes relating to the general conditions within fifteen (15) days following written notice sent by one of the parties to the other concerning the said dispute, the latter will be resolved by the competent court. In the event that any provision of the general conditions is found to be inapplicable under the law in force, the parties agree to renegotiate it in good faith in order to preserve the economic position from which they benefit as close as possible to that mentioned under the the provision rendered inapplicable. If they fail to replace this provision in a mutually acceptable and enforceable manner: This provision will be excluded from the general conditions, the remainder of the general conditions will be construed as if such provision were excluded, The remainder of the general conditions will be applicable in accordance with the terms of this last. The general conditions represent the entire agreement between the customer and relating to the subject matter referred to therein.

LA FERME DE l’OUDON will not be held responsible in the event of failure or delay in the execution of their obligations under the general conditions resulting from causes beyond their control including, and without any limitation, cases of force majeure , acts of civil or military authorities, fire, flood, earthquake, riot, war, acts of sabotage, network failure, electronic file coding error, software limitation or inability to obtain telecommunications services or government action, for provided, however, that the parties concerned take all reasonable measures to mitigate the effects resulting from said situations. The customer and LA FERME DE l’OUDON recognize and agree that the warranty exclusions as well as the limitations of liability and recourse appearing in the general conditions are tangible and constitute the bases of the general conditions. LA FERME DE l’OUDON reserves the right to modify these General Conditions at any time, without notice, it being understood that such modifications will not apply to reservations previously accepted by LA FERME DE l’OUDON. All users undertake to comply with the Specific Conditions of LA FERME DE l’OUDON, and in particular to pay all amounts due, and to accept the conditions and limitations of liability relating to the availability of the Products and Services offered. Article 14: Dispute settlement
The owners cannot be held responsible for fortuitous events, force majeure, climatic disasters or nuisances which disrupt, interrupt or prevent the stay. Any complaints regarding the equipment or the condition of the household must be made upon arrival. No complaints can be taken into account once the tenant is on the premises and the tenant will be held responsible, upon departure, for any damage or missing items. In the event of persistent disagreement, the complaint will be submitted to the owners’ legal department.

The parties agree that any disputes that arise as a result of this contract will fall under the jurisdiction of the Commercial Court of Lisieux (14) – France.
